About Courts-Martial Proceedings

When military personnel commit criminal offenses, they face legal action by courts-martial rather than in civilian courts. The Uniform Code of Military Justice (UCMJ) clearly outlines criminal offenses and their penalties, as well as Courts-Martial procedures. There are three types of courts-martial: general, summary and special. A general Courts-Martial is the most serious, and typically involves offenses which would be classified as felonies in civilian court. A special Courts-Martial is conducted for offenses which may equate misdemeanors in civilian court. A summary Courts-Martial is the least serious of the three and involves lesser offenses that are usually only punishable to pay reduction or confinement for up to 1 month.

Depending upon the severity of the offense and whether an individual faces a general, summary or special Courts-Martial, the following penalties may be imposed:

  • Death penalty
  • Imprisonment
  • Dismissal
  • Dishonorable discharge
  • Labor without confinement
  • Pay forfeiture
